PREAMBLE

The Customer declares that he/she has the full legal capacity to accept the following General Terms and Conditions. The Customer must accept these General Terms and Conditions of Sale at the time of booking (acceptance must be confirmed at the time of booking). It is not possible to make a booking without accepting these General Terms and Conditions. The Customer remains solely responsible for the choice of services and their suitability for his/her personal needs. Miramar La Cigale shall not be held liable in any way in this respect.

BOOKINGS AND PAYMENT

FOR A STAY AT LA CIGALE RESIDENCE (APARTHOTEL)

For room only packages at La Cigale Residence, Miramar La Cigale offers two types of bookings: flexible or prepaid. The “flexible” rate (standard rate) allows you cancel your stay at the hotel up to 24 hours in advance free of charge (until 3 pm on the day before your arrival). “Prepaid” bookings, also called “non cancellable - non refundable”, include a 5% discount on the flexible rate and may not be cancelled once payment has been made. The same base rate applies for bookings made over the telephone (or walk in) and via the internet, and is based on a dynamic rate called the “best available rate”.

BOOKINGS MADE DIRECTLY VIA THE CENTRAL RESERVATIONS DEPARTMENT

All bookings must be confirmed with the hotel in writing, by fax: +33 (0)2 97 53 49 37 or by e-mail: reservation@miramar-lacigale.com and will only be confirmed after payment of the deposit due (which depends on the type of booking) by cheque, cash or credit/debit card. We do not accept cheques from foreign banks:
- “Flexible” bookings: the deposit corresponds to 30% of the total amount due for your stay.
“Prepaid” bookings: the deposit corresponds to 100% of the total amount due for your stay.
At the time of booking, a credit/debit card number will be requested in order to guarantee the booking. If no payment is made, the credit/debit card will be debited following the same terms as for cancellations.
For stays of longer than one week, the services will be paid for per periods of 7 days.

STAYS AT LA CIGALE RESIDENCE

The apartments are available from 5 pm on the day of arrival and must be vacated by 12 noon on the day of departure.
Please check-in at reception at Miramar La Cigale Thalasso & Spa Hotel, open 24 hours a day, 7 days a week. 
Security deposit: A credit/debit card number is requested before checking in to the apartment. A PRE-AUTHORISATION FOR A FIXED RATE OF € 500 is carried out at check-in.
Tourist tax of € 4/pers/night is to be paid on site at the end of your stay. Children under 18 years of age are exempt from tourist tax.
Apartment rental does not include daily cleaning. Stay of 1 to 4 nights: no cleaning or change of sheets and towels (towels: changed on request). Stay of more than 4 nights: Bedroom(s), living area, bathroom(s) are cleaned once during your stay, sheets and towels are changed once (towels - changed on request)
You may ask for a late check-out at 6 pm: this is charged at € 100 and is subject to availability. Check-in before 12 noon is subject to the same conditions, i.e. for a fee of € 100.
All stays include free access to the hotel’s sports facilities during opening hours (hammam, gym, panoramic heated seawater swimming pool). Access to the facilities is only possible during the period of your stay (after 5 pm on the day of arrival and before 12 noon on the day of departure). Access to the swimming pool (9 am - 6 pm) is only permitted with flip-flops (slippers are not accepted), available at the hotel for € 7 per adult pair.
There is no room service at the aparthotel.
Inventory of fixtures: an inventory of fixtures is not offered and is not systematic. An inventory list is provided in the bedroom or at check-in and any missing items must be reported within 72 hours. After this period, any damage to the apartment not reported and noted after departure, as well as any missing tableware may be charged directly to your credit/debit card.
Any damage caused by the Customer in the apartment during his/her stay will be charged for. The hotel cannot be held liable for theft, loss or damage to luggage stored by guests in the common areas of the aparthotel, the hotel or in an unlocked apartment.

CANCELLATION POLICY - NO SHOW

FOR STAYS IN AN APARTMENT

Flexible bookings - you may cancel your stay at La Cigale Residence up to 24 hours in advance free of charge (until 3 pm on the day before your arrival). In the event of a major crisis resulting in travel restrictions preventing any stay and confirmed by government policy, the stay will automatically be postponed to 18 months after the initial arrival date. You will not be contacted again by the hotel and you will have to indicate new dates to our Reservations Department. The deposit will be retained by the hotel if you do not wish to be refunded. If this is the case (in the event of a major crisis), you will receive a refund within 1 to 4 weeks and any booking will be cancelled in our system.

Prepaid bookings – also called “non-cancellable - non-refundable” – include a 5% discount on the flexible rate and may not be cancelled once payment has been made. In the event of a major crisis resulting in travel restrictions preventing any stay and confirmed by government policy, the stay will automatically be postponed to 18 months after the initial arrival date. You will not be contacted again by the hotel and you will have to indicate new dates to our Reservations Department. The amount due for the stay will not be refunded under any circumstances.

 

STAYS AT THE APARTHOTEL INCLUDING THALASSOTHERAPY TREATMENT

Cancellation fees will be determined based on the date on which the cancellation is notified. You may cancel your stay free of charge up to 15 days in advance. After this period, the full deposit will be retained.
All cancellations must be made in writing (letter, fax, e-mail) to our Reservations Department (reservation@miramar-lacigale.com).
Any deposit paid will be refunded for cancellations made more than 15 days before the arrival date. After this period, the full deposit will be retained, however, we may also postpone the date with your agreement.
In the event of a major crisis resulting in travel restrictions preventing any stay and confirmed by government policy, the stay will automatically be postponed to 18 months after the initial arrival date. You will not be contacted again by the hotel and you will have to indicate new dates to our Reservations Department. The deposit will be retained by the hotel if you do not wish to be refunded. If this is the case (in the event of a major crisis), you will receive a refund within 1 to 4 weeks and any booking will be cancelled in our system.

 

THALASSOTHERAPY TREATMENTS FOR NON-RESIDENT GUESTS

We ask for full payment for the desired services. If the cancellation is made less than 15 days before the date of arrival or in the event of a no show, we will retain the full amount already paid for the services.
In the event of a major crisis resulting in travel restrictions preventing any stay and confirmed by government policy, the stay will automatically be postponed to 18 months after the initial arrival date. You will not be contacted again by the hotel and you will have to indicate new dates to our Reservations Department. The deposit will be retained by the hotel if you do not wish to be refunded. If this is the case (in the event of a major crisis), you will receive a refund within 1 to 4 weeks and any booking will be cancelled in our system.

RIGHT OF WITHDRAWAL

With respect to article L. 221-28 of the French Consumer Code, the Customer is reminded that he/she does not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code. The Terms and Conditions of Sale that apply to rates are indicated on the product information sheets of said rates or communicated orally for bookings made over the telephone. Prepaid bookings may not be modified and/or refunded. The full deposit will be retained by Miramar La Cigale.
When the rate allows for a modification or cancellation, please contact our Reservations Department to exercise your rights (+33 (0)2 97 53 49 13).

PERSONAL DATA

When a contract is concluded between the Customer and Miramar La Cigale, the hotel collects personal information for management purposes and for telemarketing. The Customer may object to this future telemarketing (outwith the current commercial relationship) by joining the Bloctel anti-canvassing list (https://www.bloctel.gouv.fr/). This is a right of the consumer and the Customer can specify at the time of booking that he/she does not wish to be contacted by telephone or e-mail in the future.

PROMOTIONS AND EXCLUSIVE OFFERS

The www.residence-lacigale.com website features promotional offers accessible via the menu or the homepage. These offers are subject to conditions and at the discretion of the hotel, which reserves the right to withdraw the offer (or extend the validity period) at any time. Our promotional (or exclusive) offers are non-cancellable, non-modifiable and non-refundable and are conditional on the payment of a deposit (which may vary depending on the type of offer). Our offers are subject to availability.

MEDICAL CERTIFICATES

Please note that you must send us a medical certificate issued by your doctor before your arrival at our Thalassotherapy Centre and specifying no contraindication to the practice of thalassotherapy and sporting activities. Without a medical certificate, you will be asked to sign a medical waiver and consent form on site at reception of the Thalassotherapy Centre.
Medical and physiotherapy procedures performed as part of a thalassotherapy treatment are not covered by French national health insurance - Caisse Nationale d'Assurance Maladie circular no. 5698 of 23 Dec 1998.

PETS

Dogs and cats are welcome to stay La Cigale Residence (for an extra charge of € 20/day, please check with our Reservations Department) provided they are kept on a leash on the hotel premises. However, access to the 4th floor of the hotel where the restaurants, bar, swimming pool and gym are located, as well as to the thalassotherapy facilities, is strictly forbidden.

NON-SMOKING AND NON-VAPING ESTABLISHMENT

We remind you that the entire hotel (rooms and lobby included) is NON-SMOKING and NON-VAPING.

FRENCH DATA PROTECTION ACT

As your files are subject to computerised processing, you have the right to access, modify and delete information concerning you, in accordance with the French Act on Data Processing, Data Files and Individual Liberties of 6 January 1978.

INVITATIONS

The Customer agrees to refrain from inviting any person whose behaviour could be detrimental to the establishment. The hotel reserves the right to take action if necessary.

LITIGATIONS

Any dispute or claim can only be taken into account if it is made in writing (by letter to Miramar La Cigale - Port du Crouesty CS 60003 56640 ARZON or by e-mail to directiongenerale@miramar-lacigale.com). In the event of an unresolved litigation, the consumer may bring the matter either before a court having local jurisdiction under the Code of Civil Procedure, or before the court for the place where he/she resided at the time the contract was concluded or the damaging event occurred.

FORCE MAJEURE

The establishment reserves the right not to fulfil its obligations or to postpone the performance of the latter in the event of exceptional events, or in case of force majeure (total or partial destruction of the establishment, industrial action, fire, etc.).

OMBUDSMAN

In the event of a dispute between the Customer and the Miramar La Cigale Thalasso & Spa Hotel arising from these General Terms and Conditions of Sale, the Customer is informed that he/she can have recourse to an ombudsman (Jean-Pierre Teyssier, MTV Tourism and Travel Mediator, PO Box 80 303 - 75 823 Paris Cedex 17 or on https://www.mtv.travel/) who will attempt, with complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution. The parties are free to accept or refuse the use of the ombudsman.

STAYS WITH CHILDREN

The Ocean Spa and the seawater spa circuit are reserved for guests aged 14 years and older accompanied by an adult, and the hammam is open to guests aged 16 years and older.
